Following the entry into force of the relevant amendment to the ‘Law on Information Society Services’ (LSSICE), as set
out in Royal Decree 13/2012, it is mandatory to obtain the user’s express consent on all websites that use non-essential
cookies before the user browses them.
WHAT ARE COOKIES?
Cookies and other similar technologies, such as local shared objects, Flash cookies and web beacons, are tools used by
web servers to store and retrieve information about their visitors, as well as to ensure the website functions
correctly.
The use of these devices enables the web server to remember certain details about the user, such as their preferences
for viewing the server’s web pages, their username and password, the products they are most interested in, etc.
COOKIES AFFECTED BY THE REGULATIONS AND COOKIES EXEMPT FROM THEM
According to the EU directive, the cookies that require the user’s informed consent are analytics cookies and
advertising and affiliate cookies, with the exception of technical cookies and those necessary for the functioning of
the website or the provision of services expressly requested by the user.
TYPES OF COOKIES
ACCORDING TO THE PURPOSE
Technical and functional cookies: are those that enable the user to navigate a website, platform or
application and to use the various options or services available on it.
Analytical cookies: These are cookies that enable the party responsible for them to monitor and analyse
the behaviour of users of the websites to which they are linked. The information collected through this type of cookie
is used to measure the activity on websites, applications or platforms and to create browsing profiles of users of those
websites, applications and platforms, in order to make improvements based on an analysis of the usage data provided by
users of the service.
Advertising cookies: are those that enable the most effective possible management of any advertising
space that the publisher may have included on a website, app or platform from which the requested service is provided,
based on criteria such as the content published or the frequency with which the adverts are displayed.
Behavioural advertising cookies: collect information about the user’s personal preferences and choices
(retargeting) to enable the most effective possible management of any advertising space that the publisher may have
included on a website, app or platform from which the requested service is provided.
Social media cookies: are set by social media platforms on the Services to allow you to share content
with your friends and networks. Social media platforms are able to track your online activity outside the Services. This
may affect the content and messages you see on other services you visit.
Affiliate cookies: enable us to track visits from other websites with which the website has an
affiliate agreement (affiliate companies).
Security cookies: store encrypted information to prevent the data stored in them from being vulnerable
to malicious attacks by third parties.
BY OWNERSHIP
First-party cookies: are those sent to the user’s terminal device from a computer or domain managed by
the publisher itself and from which the service requested by the user is provided.
Third-party cookies: are those sent to the user’s device from a computer or domain that is not managed
by the publisher, but by another entity that processes the data obtained through the cookies.
ACCORDING TO THE RETENTION PERIOD
Session cookies: are a type of cookie designed to collect and store data whilst the user is accessing a
website.
Persistent cookies: These are a type of cookie in which the data remains stored on the device and can
be accessed and processed for a period defined by the party responsible for the cookie, which may range from a few
minutes to several years.
